The short version
- You need to be 13 or older to make an account. If you're under 18, read these terms with a parent or guardian.
- You own the games you make. When you publish one, you let us host and show it, and let people play it. If remixing is on, people can make their own versions here, and you get credit.
- Be decent: no hate, bullying, sexual content, personal info or stolen work. We moderate, and we can remove content or accounts that break the rules.
- Credits pay for the AI that builds your games. They have no cash value and aren't refundable, except where the law says otherwise.
- Creators can earn money from their published games. Under 18, payouts go to a parent or guardian's account.
1. Welcome
Link to this section: WelcomeOddgrounds is run by Bonneville Solutions (“we”, “us”), 276 Widow Sweets Rd, Exeter, RI 02822, USA. These terms are an agreement between you and us about using oddgrounds.com, the Oddgrounds app, and the games and tools on them (together, “Oddgrounds”).
By creating an account or using Oddgrounds, you agree to these terms and to our Privacy Policy, which explains what we do with your information. If you don't agree, please don't use Oddgrounds.
2. Who can use Oddgrounds

- To make an account, you must be at least 13 years old. We ask for your date of birth when you sign up, and we don't allow accounts for anyone younger.
- If you're 13 to 17, you need your parent or guardian's permission to use Oddgrounds, and they should read these terms with you. Cash payouts and prizes need a parent or guardian to take part (see Creator earnings).
- You can't use Oddgrounds if we've banned you before, or if the law where you live doesn't allow it.
3. Your account
Link to this section: Your account- Tell the truth when you sign up, especially your date of birth. One account per person, and don't share it or sell it.
- Pick a username that isn't your real name and doesn't pretend to be someone else. Your username is public.
- Keep your password secret. You're responsible for what happens on your account. If you think someone else got in, write to support@oddgrounds.com right away.
- You can delete your account at any time on your account page. What happens to your games and data when you do is in the Privacy Policy.
4. Your games and what you post
Link to this section: Your games and what you post“Your content” means the games, levels, art, sounds, titles, descriptions, comments and messages you make or post on Oddgrounds, including what the AI builder makes for you.
You own it
As between you and us, you keep whatever rights you have in your content. We don't claim to own your games.
The permission you give us
So we can run Oddgrounds, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, run, show and share your content, and to adapt it (for example, to fit phones, make thumbnails and previews, or check it for safety). We can also show it, with credit to your username, when we promote Oddgrounds, and we can let our service providers do these things for us. This licence lasts while your content is on Oddgrounds, plus the time it takes to clear it from backups. For published versions we keep for remix credit and ownership records (see below), it lasts as long as we keep them.
Drafts and publishing
- A game is a draft until you publish it. Only you can see and play your drafts, in the studio.
- Publishing makes a game public: anyone can find it, play it, rate it and comment on it. There are no private or unlisted games.
- You can unpublish a game at any time. Once a game has been published, its published versions stay in its history, so we can show who made what first and keep remix credit right. A game that was never published can be deleted.
Your promises
When you post or publish something, you promise that you have the right to, that it follows these terms, and that it doesn't break anyone else's rights (like copyright, trademarks or privacy).
5. Remixing other people's games
Link to this section: Remixing other people's gamesA remix is a game someone makes by starting from another published game and changing it. Here's how remixing works:
- Each published game has a switch that lets others remix it. It's on unless the creator turns it off. With it off, people can still play the game, but they can't remix it or see inside it, and that covers the game's older versions too.
- If you publish a game with remixing on, you let other Oddgrounds users copy and change it on Oddgrounds to make their own games, which they may publish under these terms. That permission covers use on Oddgrounds only.
- If you turn remixing off later, nobody can start a new remix, but remixes that already exist stay up.
- A remix always credits the game it came from, and that credit can't be removed. Art and sounds taken from other games carry their own credit too.
- A remix has to be different from the original before it can be published. Your chat with the builder is never copied into someone else's remix.
- When remixes earn money, a share goes to the games they came from. The current rules are on the creator earnings page.
Copies
Don't publish a copy of someone else's game as your own. When a game is published, we compare it with other games. If it looks like a copy, we may hold it, suggest you remix the original instead, block it (if the original has remixing off), or send it to a person to review. If someone says you copied their game, we may hold the earnings of the games involved until we decide. Ideas and kinds of games (like “a platformer with a cat”) don't belong to anyone; copying someone's actual code, art or levels is what counts.
6. Rules for everyone
Link to this section: Rules for everyoneOddgrounds is for everyone 13 and up. Don't make, publish, post or ask the AI builder for anything that:
- is sexual, is extremely violent or gory, or shows or encourages self-harm;
- attacks or puts people down for who they are (such as their race, religion, gender, sexuality, disability or where they're from), or bullies, harasses or threatens anyone;
- shares personal information, like someone's real name, address, phone number, school or photos, or tries to collect it from players;
- copies someone else's game, art, music or characters without permission (including well-known games, films and brands), or pretends to be another person or brand;
- is spam, a scam, advertising or gambling, or asks players for money;
- breaks the law or helps someone else break it.
And don't:
- try to break out of the game sandbox, attack Oddgrounds or its players, spread malware, or get around our limits, filters or bans;
- fake plays, ratings, votes, reports or scores, use bots or extra accounts to do it, or cheat the creator earnings;
- scrape Oddgrounds, or copy it to train other AI models;
- use Oddgrounds in any way that could harm children or teens.
If you see something that breaks these rules, please report it with the report button on the game, comment, level or profile.
7. Moderation and enforcement
Link to this section: Moderation and enforcement- We check content automatically, and people on our team review reports and anything the checks flag.
- We can hold, hide or remove content, pause an account for a while or for good, and cancel earnings or prizes that came from breaking the rules. We decide based on how serious it is and whether it has happened before.
- We don't have to host any particular content, and we may remove content that we reasonably believe breaks these terms or the law.
- If you think we got it wrong, write to support@oddgrounds.com and tell us what happened. A person will look at it.
Copyright complaints
If you think something on Oddgrounds copies your work, write to support@oddgrounds.com with: your name and how to reach you; the work you think was copied; a link to what copies it; a statement that you believe in good faith the use isn't allowed; and a statement that your notice is accurate and that you own the work or may act for the owner. We'll look into it and may remove the content. We close the accounts of people who copy others' work again and again.
8. The AI builder
Link to this section: The AI builder- The builder uses AI to turn your messages into games. To do that, your messages, any pictures you attach and your game's files are sent to our AI provider, Anthropic. The Privacy Policy has the details.
- AI makes mistakes. A game may not work the way you asked, may have bugs, or may look a bit like something that already exists. Check what it makes before you publish: you're responsible for what you publish.
- Don't put personal information in your messages or games.
- Work made by AI may not get the same copyright protection as work made by people, and the rules differ between countries. We can't promise you'll be able to stop others from using AI-made parts of your game outside Oddgrounds.
- The art and sound library the builder uses is free for anyone to use (CC0), and our fonts use open font licences, so you can use them in your games.
9. Games made by other people
Link to this section: Games made by other peopleMost games on Oddgrounds are made by players, with AI. Each game runs in a locked-down sandbox on a separate website (oddgrounds.games), so it can't reach your account, your camera, microphone or location, or the rest of the internet. We check games when they're published and act on reports, but we can't review every game by hand before it goes up, and we're not responsible for what other players make or say. If a game is broken or not okay, please report it.
10. Credits and plans
Link to this section: Credits and plans- Playing is free. Building and changing games with the AI uses build credits. Every account gets free credits, and you can get more with a paid plan or a credit pack, or earn them from your games. Current prices, plans and credit amounts are on the pricing page.
- A build uses credits for the AI work it takes, up to a limit per build. If a build fails because of an error on our side, it doesn't use credits. If you stop a build part-way, the work done so far is charged.
- Credits aren't money. They have no cash value, can't be exchanged for cash, and can't be sold, transferred or given to another account.
- Free and plan credits are given each month. We may stop unused free and plan credits from carrying over to the next month; if we do, the pricing page will say so. Credits from packs and credits you earn don't expire while your account is open.
- We may change prices, plans, and how many credits things use. A price change for a plan you already pay for applies from your next billing period, and we'll tell you before it does.
- Plans and credit packs can't be bought in the Oddgrounds app. You can buy them on the website.
Paying
- Payments are handled by Stripe. We never see or store your full card number.
- Plans renew every month and are charged automatically until you cancel. To cancel, write to support@oddgrounds.com. Deleting your account also cancels your plan. After you cancel, your plan keeps working until the end of the month you've paid for.
- You must be allowed to use the payment method you pay with. If you're under 18, you need a parent or guardian's permission to buy anything.
- Where taxes apply, they're added at checkout.
Refunds
Credits and plans are digital and start working right away, so payments are non-refundable, except where the law gives you a right to a refund (it does in some countries) or where we choose to make an exception. If something went wrong, such as being charged twice, write to support@oddgrounds.com and we'll sort it out. If a payment is reversed or charged back, we may remove the credits it paid for.
11. Creator earnings
Link to this section: Creator earningsCreators can earn from their published games. The current rules, amounts and minimums are on the creator earnings page, and they may change.
- Build credits: your published games can earn you build credits when signed-in players spend time playing them.
- Cash: each month, a share of Oddgrounds' revenue goes into a pool, which is split between creators by how much time real players spend in their games. Remixes pass part of their share to the games they came from.
- Only real, engaged play counts. Your own plays, plays from brand-new or suspended accounts, and plays we believe are fake or automated don't count. We may hold or cancel earnings that come from breaking these terms or from copied games, or while an ownership claim is open.
- Cash is paid through Stripe, into a payout account you connect, once your earnings reach the minimum payout; smaller amounts carry over. Earnings wait about 30 days before they can be paid, in case a payment is refunded. Stripe's own terms apply to the payout account.
- If you're 18 or older, the payout account is yours.
- If you're 13 to 17, you can earn, but a parent or guardian must agree, and the payout account belongs to them, not you. We email them to ask for their consent, and we pay only into their account.
- You're responsible for any taxes on what you earn. We may ask for tax information before paying you, and we may hold back tax where the law requires.
- Earning on Oddgrounds doesn't make you our employee or partner. We may change or end the earnings program; if we end it, we'll pay out earnings that are already payable under the rules at that time.
12. Jams and prizes
Link to this section: Jams and prizesJams are game-making contests. Each jam's page lists its theme, dates, prizes and any extra rules, and those rules apply along with these terms. Prizes are open to people 13 and older; if a winner is under 18, a parent or guardian must consent and the prize is paid to them. No purchase is needed to enter or win, and jams are void where prohibited.
13. Our name, site and tools
Link to this section: Our name, site and toolsOddgrounds, our logo, Oddo, the site, the app, the builder, our templates and our code belong to us or to the people who license them to us. You may use them only to use Oddgrounds as these terms allow. If you send us ideas or feedback, we may use them without owing you anything.
14. Disclaimers
Link to this section: DisclaimersWe work hard to keep Oddgrounds safe and running, but we provide it “as is” and “as available”. To the extent the law allows, we don't promise that Oddgrounds, the AI builder or any game will always work, be free of errors or be available, or that games made by players are accurate, safe or right for you. We may change, pause or stop parts of Oddgrounds.
15. Limits on our liability
Link to this section: Limits on our liabilityTo the extent the law allows, we aren't liable for indirect or unexpected losses (like lost profits, lost data or lost opportunities), and our total liability to you for any claim about Oddgrounds is limited to the greater of what you paid us in the 12 months before the claim or US $50.
Some places don't allow these limits. Nothing in these terms limits liability that the law says can't be limited, or takes away consumer rights that a contract can't change.
16. Ending your use of Oddgrounds
Link to this section: Ending your use of Oddgrounds- You can stop using Oddgrounds and delete your account at any time on your account page.
- We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or if we need to protect other players or Oddgrounds. Where it's reasonable, we'll tell you why.
- When your account ends, so do its credits. The parts of these terms that are meant to last (like the licence for published versions kept for remix credit, the limits on liability, and governing law) keep applying.
17. Changes to these terms
Link to this section: Changes to these termsWe may update these terms as Oddgrounds changes. We'll change the date at the top, and if a change matters, we'll tell you on the site or by email before it takes effect. If you keep using Oddgrounds after that, you agree to the new terms. If you don't agree, you can delete your account.
18. Governing law and disputes
Link to this section: Governing law and disputesThese terms are governed by the laws of the State of Rhode Island, USA, and disputes about them go to the courts there, unless the law where you live lets you bring a claim in your local courts or under your local law. Before going to court, please write to support@oddgrounds.com so we can try to fix the problem.
If part of these terms can't be enforced, the rest still applies. If we don't enforce something right away, we can still enforce it later. You can't transfer these terms to someone else; we can transfer them if Oddgrounds is sold or reorganized.
